HerbOS Brand Partner Program Terms

1. Marketplace Model

HerbOS operates an affiliate marketplace model. Partner Brands pay HerbOS for marketplace access and visibility on the HerbOS platform. HerbOS earns a commission on purchases made through affiliated brand links. Commission rates vary by partnership tier: Verified (15%), Partner (20%), Pro Brand (20%), Enterprise (negotiated).

2. Anti-Kickback Compliance

HerbOS does not pay, nor permit brands to pay, any practitioner-facing compensation tied to product recommendations. Practitioners receive zero per-recommendation compensation from brand partners. All commission flows exclusively between the brand and HerbOS for marketplace access. This structure is designed to maintain the integrity of practitioner recommendations and comply with applicable anti-kickback statutes.

3. FTC Endorsement Disclosure

Partner Brand listings on HerbOS are paid placements and are labeled accordingly with a "Partner Brand" badge. Brand partners are responsible for ensuring their own product claims comply with FTC endorsement guidelines (16 CFR Part 255). Any off-platform endorsements by practitioners must include clear disclosure of any material connection per FTC requirements.

4. Product Compliance

Partner brands are solely responsible for ensuring their products comply with all applicable FDA and FTC regulations, including but not limited to labeling requirements under DSHEA, structure/function claim requirements, and Good Manufacturing Practices (GMP). HerbOS does not endorse, validate, or guarantee any partner brand's product claims, safety, or efficacy.

5. Review Integrity

HerbOS does not algorithmically boost partner brand reviews or ratings. All reviews are sorted chronologically, by rating, or by helpfulness — never by partnership tier. Partner brands may not offer compensation of any kind in exchange for reviews on the HerbOS platform.

6. Termination

HerbOS reserves the right to remove any brand partner from the marketplace for violation of these terms, for product safety concerns, for regulatory non-compliance, or for any conduct that may harm the HerbOS community or reputation.

HerbOS operates an educational herbal information platform. Partner brands are responsible for ensuring their own products comply with applicable FDA and FTC regulations. HerbOS does not endorse, validate, or guarantee any partner brand's product claims. These terms are subject to change. Continued participation in the Brand Partner Program constitutes acceptance of current terms.
